What to Do When You Encounter a Pothole in Minnesota

We're nearing the time when potholes become plentiful, aggravating many a Minnesotan during commutes around the area. Spring brings flowers and warmer weather, but it's also the perfect season for potholes thanks to the freeze-thaw cycle. This is a cycle in which water from melted snow and ice gets into cracks in the road and causes a pothole. Now, many states and drivers have to contend with these road nuances, but some of you will remember how, just a couple years ago, we were ranked #1 for the worst potholes in the US!

Minnesota's harsh winters and fluctuating temperatures lead to the formation of these potholes, and until there are innovations that reduce them, they are back on the radar for spring 2025. 

So, What Should You Do If You Encounter a Pothole while Driving?

Avoid the pothole, if safe to do so: First, reduce your speed as you approach the pothole. If it is safe to do so, steer your vehicle around it, but be mindful of other vehicles and pedestrians. Sudden swerving can lead to collisions, so always prioritize safety. If you drive a route that is littered with potholes, consider taking another route until the road is repaired. 

Reduce your speed when going over the pothole: If you cannot avoid hitting a pothole, try to go over it at a slow speed. This will minimize any damage to your vehicle and reduce the risk of injury. After passing the pothole, check your vehicle for any signs of damage, such as misalignment, tire issues, or unusual noises. If you notice anything concerning, have your vehicle inspected by a professional mechanic. You may remember from our prior article that potholes can do a fair share of damage to a car.

Report the pothole(s): Reporting potholes is important for road maintenance. In Minnesota, you can report a pothole through various channels. MnDOt has provided instructions for how to report a pothole depending on where it is located. Provide specific details about the location, including street names, cross streets, and any landmarks that may help pinpoint the area.

Is Anything Being Done About Potholes in Minnesota?

Yes! We have MnRoad, which is a materials and road research facility. The researchers here look for find solutions to issues like potholes. 

St. Paul voters also overwhelmingly approved a 1% sales tax increase that includes funding for roads. It was implemented April 1, 2024.

If My Car was Damaged by a Pothole, is MnDOT Liable?

You can file a negligence tort claim. In order for MnDOT to be liable, the following must be true, per the MnDOT website: "Most tort claims are claims of negligence. Under Minnesota law, a party is negligent when it breaches a legal duty to another party, directly causing damage to the other party. In the context of claims related to the condition of a highway (such as potholes and debris on the road), MnDOT is negligent ONLY if MnDOT had prior notice of the condition and a reasonable period of time to repair, correct, or warn of the condition."
